Eligibility Requirements for Free Drug Testing and Program Procedures
Local Sponsoring Chamber
To participate in the Illinois Chamber’s drug testing program for small- and medium-size businesses (with less than 500 employees locally), a local chamber of commerce must become a member of the Illinois Chamber of Commerce and sign the letter of agreement stating that they wish to become a sponsoring chamber of the program. The local chamber then selects a provider and/or providers who will assist their members in developing drug-free workplace policies and procedures.
Drug Testing Provider - Hospital and/or Clinic
To participate in the Illinois Chamber’s drug testing program for small- and medium-size businesses, a hospital and/or clinic must become a member of the local sponsoring chamber of commerce. The local provider works with the local sponsoring chamber in promoting the program, and where applicable, assists businesses in developing drug-free workplace policies and procedures, conducts the drug testing and administers the program in compliance with the Illinois Drug-Testing Program Provider’s Agreement for SFY2007.
Business – the Participating Employer
To participate in the Illinois Chamber’s drug testing program for small- and medium-size businesses, a business must meet the following eligibility requirements:
- Business must operate in Illinois.
- Business must not be mandated by federal or state law to drug test.
- Business must have 500 or less full-time employees in the local community.
- Business must have an existing drug-free workplace policy and procedures in place.
- Business must not be currently conducting the type of drug testing for which funding is requested. An example, a business may be conducting pre-employment drug testing, but now wishes to conduct random drug testing, reasonable suspicion drug testing and/or post accident drug testing. The business then may be eligible for the particular type of drug testing that they are not currently conducting.
- Business must be a member of the local sponsoring chamber of commerce and/or the Illinois Chamber of Commerce.
Businesses with Multiple Locations Statewide
If a business has multiple locations throughout Illinois and meets the eligibility requirements of the program, a specifically designed package will be developed at that time to implement the program.
Program Procedures for Positive Drug Tests
We recommend that when an individual tests positive on a drug test that he/she be given an opportunity to either enter treatment through his/her employer’s Employee Assistance Program (EAP), or in the case of a pre-employment test or lack of an EAP, be made aware of the treatment services provided by the Illinois Department of Human Services, Office of Alcoholism and Substance Abuse. Drug-Free Workplace Policies Review
It is recommended that all businesses participating in this program have an attorney review and approve their drug-free workplace policy and procedures.
Business Plans – 12-month, 24-month, 36-month
After meeting the above eligibility requirements, a business is then placed into one of the following plans:
36-month Plan
Businesses that employ between 1 - 99 employees and meet the other eligibility requirements of the program can qualify for up to $5,000 worth of free drug testing to be used during a 36-month period so long as funding is available from the Illinois Department of Human Services, Office of Alcoholism and Substance Abuse.
24-month Plan
Businesses that employ between 100 - 249 employees and meet the other eligibility requirements of the program can qualify for up to $5,000 worth of free drug testing to be used during a 24-month period so long as funding is available from the Illinois Department of Human Services, Office of Alcoholism and Substance Abuse.
12-month Plan
Businesses that employ between 250 - 500 employees and meet the other eligibility requirements of the program can qualify for up to $5,000 worth of free drug testing to be used during a 12-month period so long as funding is available from the Illinois Department of Human Services, Office of Alcoholism and Substance Abuse.
The Payment Agreement
The Illinois Chamber of Commerce will be bound only upon execution of a written agreement between the drug-testing provider and the Illinois Chamber of Commerce. Inability to successfully execute a written letter of agreement satisfactory to both parties within a reasonable time, as determined by the Illinois Chamber of Commerce, will constitute a sufficient basis for rejecting the sponsoring chamber, the provider and/or the business’s application.
Payment
Payment on executed letters of agreement will occur in response to invoices submitted monthly by the drug-testing provider directly to Julie Brennan, the Grant Administrator at the Illinois Chamber of Commerce, 215 East Adams St., Springfield, IL 62701 as outlined in the Illinois Drug-Testing Program’s Providers Agreement – SFY’2007 – Form B.
Billing Notice to Providers (hospitals, clinics, third party providers of drug testing) - Important
Hospitals and clinics that provide drug-testing services must bill on a monthly basis, and invoices will be paid only as long as funding is available from the Illinois Department of Human Services. All billing for State Fiscal Year 2007 ends June 30, 2007 and must be received by Julie Brennan at the Illinois Chamber no later than July 30, 2007 in order to receive payment and that is only if enough funding is still available for that specific fiscal year. The next new fiscal year and new funding starts July 1, 2008.

The Program Application and Approval Process
- The local sponsoring chamber's executive director sends a letter of understanding (Form A) to the executive director of the Drug-Free Illinois Workplace Program (DFIWP) stating that the local chamber wishes to participate as a sponsoring chamber in the program. The local chamber selects a provider and/or providers that work with the local eligible businesses in developing their drug-free workplaces. The local provider(s) work with the local chamber to introduce, promote and implement the program in their community.
- The local provider's representative signs the Illinois Drug-Testing Program Provider’s Agreement SFY’2007 (Form B) and sends this agreement to the executive director of the sponsoring local chamber. This agreement is then forwarded; along with a letter from the local chamber executive to the executive director of the DFIWP stating that this is or these are their provider(s) for the local chamber and these are the signed agreement(s).
- A letter (Form C) is sent from the executive director of the DFIWP to the sponsoring chamber's executive director and the local provider welcoming them into the program and acknowledging receipt of their letter of understanding and the provider’s agreement SFY’2007.
- When a business wishes to participate in this program, the local chamber executive director sends a letter stating the business’s profile (Form D) and a copy of their drug-free workplace policy and procedure to the executive director of the DFIWP to verify they have a policy.
- Upon receipt of the business’s profile, the executive director of the DFIWP reviews the profile and if approved, sends a letter (Form E) back to the local chamber executive director with a copy of the letter to the local chamber contact, the provider and the business admitting them into the program. This letter is valid only so long as funding is available from the Illinois Department of Human Services.
- When a business has utilized the $5,000, and/or the business has completed the 12-month plan, 24-month plan or the 36-month plan, whichever comes first, and/or if funding is no longer available from the Illinois Department of Human Services, a letter is sent to the sponsoring chamber, the provider, and the participating business, stating that the business's participation in this program has ended. This letter terminates the business's drug-testing payments by the Illinois Chamber of Commerce from funds received from the Illinois Department of Human Services.
NOTE: If a business wishes to participate and the local chamber of commerce is not a sponsoring chamber, an eligible business can become a member of the Illinois Chamber and the Illinois Chamber will become the sponsoring chamber for that business.
