Air Pollution Operating Permits and Fees by Cook County

WHEREAS the business and industries within the boundaries of Cook County contribute significantly to the qualify of life of its residents by providing jobs and services; AND

WHEREAS, air pollutant emissions associated with the industrial businesses within the Cook County boundaries are stringently regulated by the Illinois EPA to protect the health of all residents while maintaining a competitively level playing field within Illinois and across state boundaries; AND

WHEREAS, the imposition of a county-level annual air pollution operating permit and fee would impose a disparate and undue regulatory burden on Cook County business and industry, based solely on their geography, thus severely restricting their ability to compete in the marketplace; AND

WHEREAS, the proposed fees exceed any legitimate cost to the County to administer the proposed program, which effectively renders the fee proposed a new business tax;
