Q. I’m so confused by all the new FMLA forms, what are the new forms and when should I use them?
A. Below I have a list of all six of the new forms explaining when they should be used and a link so that you can download them for free. I hope this helps with some of the confusion.
Form WH-380-E
The Certificate of Health Care Provider for Employee’s Serious Health Condition
This form is very similar to the old Certificate of Health Care Provider form, it is specifically designed for use when the leave is for the employee’s own illness. Employers may attach a job description to explain to the physician what the essential job functions are to better aid the doctor in determining when the employee can return to work and if light duty will be recommended.
Form WH-380-F
The Certificate of Health Care Provider for Family Member’s Serious Health Condition
This form is specifically made for use when the leave is for an immediate family member’s serious health condition (parent, child, or spouse), that requires the employee’s care.
Form WH-381
Notice of Eligibility and Rights & Responsibilities
This form replaces the old Employer Response to Employee Request for FMLA form. The new form goes into more detail explaining both the rights and responsibilities of the employee than the old Form 381 did. The new 381 form also includes information regarding if the leave is to care for a next of kin of a covered servicemember with a serious injury or illness.
Form WH-832
Designation Notice
This notice formally designates the leave as counted toward the employee’s FMLA entitlement, or denies the requested leave.
Form WH-384
Certification of Qualifying Exigency for Military Family Leave
This is a new section of the law providing leave for an immediate family member of a military servicemember, to allow them up to 12 weeks off to take care of personal business because their parent, spouse or child has been called to active duty.
Form WH-385
Certification for Serious Injury or Illness of Covered Servicemember for Military Family Leave
This new section of the law allows an immediate family member of covered servicemembers with a serious illness or injury incurred in the line of duty up to 26 workweeks of leave in a single 12-month period.
